Terms of Service

The terms that apply when you use this website and engage our services.
LAST UPDATED: AUGUST 24, 2026

Agreement to These Terms

These Terms of Service govern your use of rtsmithco.com and the information, tools, and materials made available through it. By browsing this website, submitting a form, or using the client portal, you agree to these terms. If you do not agree with them, please do not use the site.

We may need to revise these terms as our services or the law change. The version posted on this page is the one that applies, and the date above tells you when it last changed.

About RT Smith & Company

RT Smith & Company is a tax practice based in Las Vegas, Nevada. We provide tax preparation, bookkeeping, tax consulting, and IRS problem resolution services to individuals and businesses. This website describes those services and gives you a way to reach us. It is not a substitute for professional advice on your own situation.

Information Here Is Not Tax or Legal Advice

Everything published on this site, including service pages, FAQ answers, and blog posts, is general information provided for marketing purposes. Tax outcomes depend on facts that differ from one taxpayer to the next.

Reading this website does not create a client relationship with us. Please do not act, or decide not to act, based on what you read here without first speaking with one of our tax professionals about your specific circumstances.

When We Become Your Representative

We begin work for you only after both sides have agreed in writing, we have completed our conflict and eligibility checks, and, where a taxing authority is involved, you have signed the appropriate authorization forms such as IRS Form 2848 or Form 8821.

Submitting a contact form, booking a free consultation, or sending us an email does not by itself engage our services. Your signed engagement letter, not this page, sets out the scope, fees, and terms of the work we perform for you. Where the two conflict, your engagement letter controls.

No Guarantee of Results

Tax resolution outcomes depend on your financial circumstances, your filing and payment history, and the discretion of the IRS or state agency reviewing your case. We cannot and do not promise any particular result, including acceptance of an offer in compromise, a specific settlement amount, penalty abatement, release of a lien or levy, or a set timeline.

Any examples, figures, or past results mentioned on this site are illustrations of work we have done for other taxpayers. They are not predictions of what will happen in your case.

Your Responsibilities

When you work with us, you agree to provide accurate and complete information, to respond to requests for documents in a timely way, and to tell us promptly when something material changes, including any notice you receive from the IRS or a state agency. We rely on what you give us, and the quality and speed of our work depend on it.

Acceptable Use of This Website

You may use this website for lawful purposes only. You agree not to attempt unauthorized access to any part of the site or its systems, upload malicious code, harvest data by automated means, interfere with the operation or security of the site, impersonate another person, or use our forms to send unsolicited commercial messages. We may restrict or block access where we believe the site is being used in breach of these terms.

Client Portal Accounts

Where we give you access to the client portal, your login credentials are yours alone. Please keep them confidential, do not share them, and tell us immediately if you believe your account has been accessed without your permission. You are responsible for activity that takes place under your login.

We may suspend or close a portal account where we suspect misuse, or after your engagement with us has ended and our retention obligations have been met.

Documents and Information You Send Us

You keep ownership of the documents and information you provide. By sending them to us, you authorize us to use, store, and transmit that material as needed to deliver the services you have asked for, including submitting it to the IRS or a state tax authority where your case requires it.

How we collect, use, and safeguard personal information is described in our Privacy Policy, which forms part of these terms.

Intellectual Property

The content of this website, including text, graphics, logos, page layouts, and descriptions of our services, belongs to RT Smith & Company and is protected by copyright and trademark law. You are welcome to view or print pages for your own personal, non-commercial reference. You may not copy, republish, modify, distribute, or use our content or branding for commercial purposes without our written permission.

Links to Other Websites

We may link to IRS resources, state tax agencies, or other third-party websites for your convenience. We do not control those sites and are not responsible for their content, accuracy, availability, or privacy practices. A link is not an endorsement, and your use of a linked site is governed by that site’s own terms.

Fees and Payment

Fees for our services are set out in your engagement letter or written quote and are not published on this website. Unless your engagement letter provides otherwise, invoices are payable when presented, and we may pause work on an account that is past due. Filing fees and any amounts owed to a taxing authority are separate from our fees and remain your responsibility.

Disclaimer of Warranties

This website is provided on an as-is and as-available basis. While we work to keep it accurate and current, we do not warrant that the content is complete or free of errors or omissions, or that the site will be uninterrupted, secure, or free of harmful components. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by Nevada law, RT Smith & Company and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or penalties and interest assessed by a taxing authority, arising out of your access to or use of this website.

This section applies to your use of the website. Responsibility for the professional services we perform for you is governed by your signed engagement letter and by the professional standards that apply to our practice.

Indemnification

You agree to indemnify and hold RT Smith & Company harmless from claims, losses, and reasonable costs, including attorney fees, arising from your misuse of this website, your breach of these terms, or information you supply to us that is inaccurate or incomplete.

Governing Law

These terms are governed by the laws of the State of Nevada, without regard to its conflict of law rules. Any dispute relating to this website or to these terms will be brought in the state or federal courts located in Clark County, Nevada, and you agree to that venue. If any provision of these terms is found unenforceable, the remaining provisions stay in effect.

Changes to These Terms

We may update these terms from time to time. Any change takes effect when it is posted on this page with a new last-updated date. Continuing to use the site after that means you accept the revised terms, so please check back periodically.
